These terms govern your use of jfxaudio.com (the "Site"), operated by jfxAudio ("we", "us"). By using the Site you agree to these terms. If you don't agree, please don't use the Site.

1. Who can use the Site

You must be at least 13 years old to use the Site. If you're under 18, you need a parent's or guardian's permission. You're responsible for complying with the laws that apply to you.

2. Your account

• An account is optional. It lets you save favorite chords and preferences.
• Give accurate information, keep your password secure, and tell us at support@jfxaudio.com if you think someone else has accessed your account. You're responsible for activity under your account.
• If you sign in with Google, your use of your Google account is also subject to Google's terms. You can remove jfxAudio's access from your Google account at any time.
• You can ask us to delete your account at any time. We may suspend or close accounts that break these terms.

3. Using the Site

You may use the Site for your own personal, non-commercial learning and music-making. You agree not to:

• copy, republish, sell or redistribute substantial parts of the Site's content, such as articles, chord diagrams or data, without our written permission (sharing links and short quotes with attribution is fine);
• scrape, crawl or bulk-download the Site or its API, except for search engines indexing public pages;
• interfere with the Site, try to get around its security, or access accounts or data that aren't yours;
• use the Site for anything unlawful, or to harass or harm others; or
• frame the Site or present it as part of another website without permission.

4. Our content

The Site, including its articles, tools, chord and scale diagrams, design, text, graphics and code, is owned by jfxAudio or its licensors and protected by copyright and other laws. These terms don't transfer any ownership to you. "jfxAudio" and our logo may not be used without our permission.

Scales, notes, chords and other music theory facts aren't owned by anyone, and you're free to use them in your own playing, teaching and music.

5. Educational information

The Site's lessons, articles and tools are for general educational purposes. We work to keep them accurate, but they may contain mistakes or omissions and are provided without guarantees. Practice safely and take breaks to avoid strain or injury. If you notice an error, please let us know.

6. Ads and links to other sites

The Site is free and supported by advertising, including ads from Google. Ads and links may lead to websites we don't control, and we aren't responsible for their content, products or practices. Your dealings with advertisers are between you and them.

7. Privacy

Our Privacy Policy explains how we collect and use information, including cookies, advertising and Google sign-in.

8. Changes to the Site

We may change, suspend or discontinue any part of the Site at any time, including features, content or accounts, without liability to you.

9. Disclaimer

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't guarantee that the Site will be uninterrupted, secure or error-free.

10. Limitation of liability

To the fullest extent permitted by law, jfxAudio won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to the greater of the amount you paid us in the 12 months before the claim (if any) or US $50. Some jurisdictions don't allow these limitations, so they may not all apply to you.

11. Indemnity

You agree to indemnify and hold jfxAudio harmless from claims, losses and expenses, including reasonable legal fees, arising from your misuse of the Site or your breach of these terms.

12. Ending your use

You can stop using the Site at any time. We may suspend or end your access if you break these terms. Sections 4 and 9 to 13 continue to apply after that.

13. Governing law

These terms are governed by the laws of the Commonwealth of Virginia and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Virginia, and you and we consent to their jurisdiction. If you live in a country whose consumer protection laws give you the right to bring claims in your own courts, these terms don't take that right away.

14. Changes to these terms

We may update these terms from time to time. We'll change the "Last updated" date above, and for significant changes we'll give more prominent notice on the Site. If you keep using the Site after changes take effect, you accept the updated terms.

15. General

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and jfxAudio about the Site.
